Admin 02-04-2026 International Aviation Law

The Supreme Court dismissed a plea seeking modification of the AAIB preliminary report on the Air India Ahmedabad crash, stating that courts cannot interfere in ongoing technical investigations and advising the petitioner to seek information through RTI.

  1. PIL Rejected:
The Supreme Court dismissed a petition seeking “reading down” of the AAIB preliminary report on the Ahmedabad Air India crash.
  2. What the Petitioner Wanted:
    • Inclusion of a complete sequence of events with timeline
    • Detailed time chart of engine flameout
    • Clarification on whether fuel switch movement was manual or mechanical
    • Court’s Strong Observation:
The bench questioned the petitioner’s motive, asking about a “deep-rooted agenda” behind filing such a plea.
    • Bench Composition:
Headed by CJI Surya Kant, along with Justices Joymalya Bagchi and Vipul Pancholi.
    • No Direct Victims Involved:
Court noted that families of victims had not approached the Court, raising doubts about the PIL.
    •  Alternative Remedy Suggested:
The Court indicated that the petitioner could use the Right to Information (RTI) route instead.
  • Earlier Rejection:
The Delhi High Court had already dismissed a similar plea before this appeal.
